An employee who brings a claim against their employer is normally referred to as the ‘Claimant’. The employer is referred to as the ‘Respondent’.
Even though it is not lawfully mandatory, Tribunals place a great onus on employees and employers following the ACAS Code of Practice for Disciplinary and Grievance Procedures and, therefore, if the employee or employer fails to follow the Code, Tribunals can increase or decrease any award by up to 25%.
Therefore it is very important that you take advice on the procedures, which you should follow to avoid any potential penalties.
